Terms of service

The agreement between you and ServersCamp.

Last updated: October 21, 2026·Effective: October 21, 2026

1. The agreement

These Terms of Service form a contract between you and ServersCamp S.R.L. ("ServersCamp", "we", "us"), a company registered in Romania.

By creating an account, deploying a resource, or otherwise using our services, you agree to these terms. If you are using ServersCamp on behalf of a company, you confirm you have authority to bind that company.

2. Your account

  • You must be at least 16 years old, and able to enter a binding contract under your local law
  • You are responsible for keeping your account credentials safe. We strongly recommend enabling MFA.
  • You are responsible for what happens under your account, whether you did it personally or someone you let in did it
  • One welcome credit per individual, organisation and payment card. Creating multiple accounts, or saving the same card on several accounts, to claim the credit again is not allowed.
  • You must confirm your email address and save a payment card before the account can create resources. Until then you can sign in, fill in billing details and open support tickets.
  • Tell us promptly if you believe your account has been compromised: [email protected]

3. The service

ServersCamp provides cloud infrastructure: virtual machines, block and object storage, networking, and managed services such as PostgreSQL. The exact list and pricing of available products is on our pricing page and may change over time.

Service level agreement (SLA)

We commit to 99.99% monthly uptime for the production infrastructure. If we miss this target in a given calendar month, you are entitled to service credits applied automatically to your next invoice:

  • Below 99.99% but at or above 99.9% - 10% of monthly fees for affected resources
  • Below 99.9% but at or above 99% - 25% of monthly fees
  • Below 99% - 50% of monthly fees

Credits are the sole and exclusive remedy for SLA breaches. Credits are not refundable for cash. Planned maintenance with at least 7 days' notice does not count toward downtime. Force majeure events (e.g., upstream network outages outside any reasonable provider's control) do not count.

Simple VPS

Simple VPS runs on capacity we have free and is not covered by the SLA above. We aim for 99.9% monthly uptime and pay no service credits when we miss it. If a VPS takes much more than its share of the host, or is used against the Acceptable Use Policy, we may lower its CPU, disk speed or network speed at any time, with or without notice. After the monthly traffic quota its port runs at 100 Mbit/s until the next month.

For a VPS created before October 21, 2026 this section applies from November 21, 2026.

4. Acceptable use

What you may run on ServersCamp and how we enforce it is set out in our Acceptable Use Policy, which is part of these terms.

5. Payment

  • Most resources are billed by the actual hour of usage, summarised into a monthly invoice. Some products (e.g., reserved capacity) may be billed up front.
  • A calendar month has between 672 and 744 hours. Your real bill is the sum of actual hourly usage; our online calculator uses a fixed average of 720 hours per month for an at-a-glance estimate, so the calculator and your invoice may differ by a few percent depending on which month it is.
  • You can pay by credit/debit card via Stripe or by SEPA bank transfer to our BCR (Banca Comercială Română) account
  • Invoices are issued through Oblio in compliance with Romanian tax law
  • VAT is added where applicable. EU business customers with a valid VAT ID may qualify for reverse charge.
  • Accounts are prepaid: you top up your balance by card, and the card is charged only when you do so. We charge a saved card on our own only when you have switched on auto top-up: the top-up amount you set plus VAT where it applies, at most once a day and within the monthly limit you set. You can switch it off at any time; a charge already submitted to your bank may still complete. A fiscal invoice is issued for every payment.
  • If an invoice is more than 7 days overdue we may suspend service. After 30 days we may terminate the account and delete data.
  • Welcome credit of EUR 10 is issued when a payment card is saved, once per organisation and once per card, and is valid for 10 days from issue. Unused credit expires and is not redeemable for cash. Resources running when the credit is exhausted or expired require a top-up to continue.
  • Welcome credit requires a saved card. If the last card is removed from the account before the first top-up, the unused welcome credit is forfeited and is not restored when a card is added again. Money you paid in is never affected.
  • If a payment is charged back or refunded, the welcome credit issued on that payment is removed together with it.
  • Every signup is checked for signs of duplicate or fraudulent registration: proxy and VPN use, a device already tied to another account, and third-party risk scoring among them. Where that check returns a strong signal we withhold the welcome credit and hold the account for review. Open a support ticket and a person will look at it.
  • The welcome credit is a gift, not a purchase, and we may withdraw it after it has been issued. We do so when an account turns out to be one of several run by the same person, when the card behind it is disposable, stolen or later disputed, when the credit is spent on workloads the Acceptable Use Policy prohibits, or when the signup checks above flag the account after the fact. Withdrawal removes the unused part of the credit at once; resources paid for with it may be stopped. Credit you bought with your own money is never touched by this.
  • While an account runs on welcome or promotional credit, creating new resources requires at least EUR 1 of usable credit. Resources already running are not affected by this.
  • Refunds: usage-based fees are not refundable. Pre-paid amounts are refundable on a pro-rata basis if we materially fail the SLA or otherwise breach these terms.

6. Cancelling or ending the contract

You can cancel at any time from your account settings. Outstanding usage will be billed in the next invoice. Closing your account immediately and irreversibly deletes all your resources and data on our systems - there is no recovery window. Records held by our payment processor (Stripe) and our invoicing partner (Oblio) remain under their own retention policies, driven by Romanian tax law and PCI compliance; deleting those records is outside our control.

We may terminate or suspend your account if you breach these terms, fail to pay, commit fraud, or use the service in a way that creates legal risk for us. For non-urgent cases we will give you reasonable notice and a chance to cure.

7. Ownership

We own ServersCamp - the platform, the brand, the documentation, the code we wrote. You don't get any rights in those except the right to use the service while your account is active.

You own everything you put into ServersCamp - your VMs, your data, your applications. You grant us only the permission we need to host and operate it on your behalf (store it, transmit it, back it up, restore it).

8. Warranties and disclaimer

We warrant that we will provide the service with reasonable skill and care, in accordance with the SLA. Beyond that, the service is provided "as is". We do not warrant that the service will meet your specific needs, be uninterrupted beyond the SLA, or be error-free.

9. Limitation of liability

To the fullest extent permitted by law:

  • Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption
  • Our total liability under or in connection with these terms is capped at the fees you paid us in the 12 months immediately preceding the claim
  • The above does not exclude liability that cannot be excluded under Romanian law (e.g., for gross negligence, wilful misconduct, or death/personal injury caused by negligence)

10. Indemnification

You agree to indemnify us against third-party claims arising from your content or your use of the service in breach of these terms or applicable law. We will tell you promptly about any claim and let you take over the defence at your cost.

11. Confidentiality

If either side shares non-public information with the other, the receiving side will treat it as confidential and use it only to perform under these terms. This does not apply to information that is or becomes public, was already known, or must be disclosed by law.

12. Data protection

How we handle personal data is described in our Privacy Policy, which is part of these terms. For business customers who need a Data Processing Agreement under GDPR, contact [email protected].

13. Changes to these terms

We may update these terms from time to time. For material changes we will email you and post a banner on the site at least 30 days before the change takes effect. If you don't accept the changes you can cancel; otherwise continued use after the effective date counts as acceptance.

14. Governing law and disputes

These terms are governed by the laws of Romania, without regard to conflict-of-laws rules. Any dispute that cannot be resolved by good-faith discussion will be brought before the competent courts of Bucharest, Romania.

If you are a consumer in another EU country, mandatory consumer-protection laws of your country may also apply, and nothing in this section limits the protections you have under those laws.

15. Miscellaneous

  • No assignment. You may not transfer your account to anyone else without our written permission. We may assign the agreement (e.g., as part of a merger or acquisition).
  • No agency. Nothing here creates a partnership, joint venture, or employment relationship.
  • Severability. If a court holds any part of these terms unenforceable, the rest stays in force.
  • Entire agreement. These terms, together with the Acceptable Use Policy, the Privacy Policy and any signed Order Form, are the entire agreement between you and us about the service.
